Terms of Service JobsGenerator

1.1"JobsGenerator": JobsGenerator B.V., established in the Netherlands,provider of the SaaS application.
1.2"Service": the online software-as-a-service application forgenerating job profiles.
1.3"User": the natural person or legal entity entering into an agreementwith JobsGenerator.
1.4"Agreement": the agreement between JobsGenerator and User for the useof the Service.
1.5"Content": all information, texts and data entered by User via theService.
2.1 These Termsof Service apply to all offers, agreements and services of JobsGenerator.
2.2 Deviationsfrom these terms are only valid if agreed in writing.
2.3 Any purchaseor other terms of User are expressly rejected.
3.1 The Agreementis formed when User creates an account and/or makes a payment.
3.2 JobsGeneratorreserves the right to refuse a request without stating reasons.
4.1 JobsGeneratorgrants User a non-exclusive, non-transferable right to use the Service duringthe term of the Agreement.
4.2 The Serviceis offered "as is". JobsGenerator aims for 99% availability but doesnot guarantee uninterrupted access.
4.3 JobsGeneratormay modify, expand or discontinue the Service with reasonable notice.
4.4 Scheduledmaintenance will be communicated in advance where possible.
5.1 User isresponsible for keeping login credentials confidential.
5.2 User warrantsthat Content does not infringe on rights of third parties.
5.3 It is notpermitted to:
• Use the Service for unlawful purposes
• Process direct personal data of candidateswithout legal basis
• Reverse-engineer or copy the Service
• Resell the Service to third parties
6.1 Current feesare listed on the website. All prices exclude VAT unless otherwise stated.
6.2 Payment ismade in advance via the offered payment methods (Mollie).
6.3 In case oflate payment, JobsGenerator is entitled to suspend access to the Service.
6.4 JobsGeneratorreserves the right to change fees. Changes will be announced at least 30 daysin advance.
7.1 Allintellectual property rights to the Service, software, designs anddocumentation belong to JobsGenerator.
7.2 User retainsall rights to Content entered by User.
7.3 User grantsJobsGenerator a limited license to process Content for delivering the Service.
7.4 JobsGeneratormay use anonymized and aggregated data for improvement of the Service.
8.1 JobsGeneratorprocesses personal data in accordance with the Privacy Policy and GDPR.
8.2 If Userenters personal data of third parties (such as candidates), User is the datacontroller. A data processing agreement can be concluded upon request.
8.3 JobsGeneratorimplements appropriate technical and organizational security measures.
9.1JobsGenerator's total liability is limited to the amount User has paid in the12 months preceding the damage-causing event, with a maximum of €1,000.
9.2 JobsGeneratoris not liable for:
• Indirect damage, consequential damage,lost profits or missed savings
• Damage due to incorrect use of the Service
• Damage due to decisions based on generatedjob profiles
• Damage due to force majeure
9.3 Limitationsdo not apply in case of intent or gross negligence by JobsGenerator.
10.1JobsGenerator does not warrant that generated job profiles are suitable forspecific purposes or comply with specific laws or regulations.
10.2 User remainsresponsible at all times for HR decisions and compliance with employment lawobligations.
10.3 The Serviceis a tool; professional HR advice is recommended for important decisions.
11.1 TheAgreement is entered into per transaction (pay-per-use) or for the period ofany subscription.
11.2 Both partiesmay terminate the Agreement with 30 days' notice.
11.3JobsGenerator may terminate the Agreement immediately in case of:
• Breach of these terms
• Unlawful use of the Service
• Bankruptcy or moratorium of User
11.4 Upontermination, User retains 30 days access to export Content.
12.1JobsGenerator is not liable for failures caused by force majeure, including:disruptions at third parties, power outages, cyber attacks, pandemics, naturaldisasters or government measures.
13.1JobsGenerator may change these terms. Changes will be announced at least 30days in advance.
13.2 In case ofmaterial changes to User's detriment, User has the right to terminate theAgreement.
14.1 ThisAgreement is governed by Dutch law.
14.2 Disputeswill preferably be resolved through mutual consultation.
14.3 Ifconsultation does not lead to a solution, the Amsterdam court has exclusivejurisdiction.
14.4 Forconsumers within the EU, the European platform for online dispute resolution(ODR) is also available: ec.europa.eu/odr.
15.1 If anyprovision is void or voidable, the remaining provisions remain in force.
15.2 Failure toexercise rights by JobsGenerator does not constitute waiver of those rights.
15.3 These termsare drafted in Dutch. In case of translations, the Dutch text prevails.
